How do I place an order?
To place an order, you must be of legal age, follow the online buying procedure and click “Accept” (for card payments) or “Pay Now” (for PayPal payments). Afterwards, you will receive an email acknowledging receipt of your order (“Order Confirmation”). Likewise, we will inform you via email that the product is being shipped (the “Shipping Confirmation”).
What is the availability of the illustrations?
All orders are subject to the availability of the illustrations. If difficulties arise in the supply of the illustrations or they no longer in stock, we will refund any amount you may have paid.
What is the delivery time of the illustrations?
Barring unforeseen or extraordinary circumstances, we will send your order for the illustrations listed in each Order Confirmed within the period indicated on the website according to the selected shipping method and, in any case, within a maximum period of 30 days counting from the Order Confirmation date.
If for any reason we were unable to meet the delivery deadline, we will inform you of this circumstance and give you the option to proceed with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid. Please note that, in any case, we do not deliver at home on Saturdays or Sundays.
For the purposes of these Conditions, “delivery” will be understood to have taken place or that the order has been “delivered” when you, or a third party indicated by you, acquires material possession of the products, which will be evidenced by the signature of receipt of the order at the agreed delivery address.
What happens if the delivery is impossible?
If we are unable to deliver your order, we will try to find a safe place to leave it. If we cannot find a safe place, your order will be returned to the warehouse of the assigned carrier. Likewise, the carrier will leave a note explaining where your order is and how to receive it. If you are not going to be in the place of delivery at the agreed time, please contact the carrier to arrange the delivery on another day.
In the event that 15 days have elapsed from when your order is available for delivery and the order has not been delivered for reasons not attributable to us, we will understand that you want to withdraw from the contract and consider it terminated. As a result of the termination of the contract, we will refund all payments received from you, including delivery charges (with the exception of the return costs incurred) without undue delay and in any event no later than 14 days from the date we consider the contract terminated. Please bear in mind that the transport costs arising from termination may involve additional costs, that we will be authorised to pass on to you.

When does the transfer of ownership take place and what are the risks?
The risks of the illustrations will be borne by you from the moment of delivery.
You will acquire ownership of the illustrations when we receive full payment of all amounts due in connection with the artwork, including shipping costs, or upon delivery, whichever occurs later.
If the products are returned, Arturo Elena does not assume ownership of the returned product until it has been received at the return address.
What is our pricing and payment policy?
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due.
Prices may change at any time, but (except as set out above) any changes will not affect orders or purchases for which the User has already received an Order Confirmation.
Once you have selected all the items you want to buy, they will be added to the cart and the next step will be to process the order and carry out the payment. To do this, you must follow all the steps of the buying process, completing or checking the information in each step as required. Also, during the buying process, you can modify your order information before payment. Furthermore, if you are a registered user, you can consult details of all orders placed.
You can use Visa, Mastercard, American Express or PayPal as a means of payment.
By clicking “Authorise payment” you are confirming that the credit card is yours or that you are the legitimate holder of the gift card or credit card.
To minimise the risk of unauthorised access, your credit card data will be encrypted. Credit cards will be subject to checks and authorisations by the issuing bank, If the bank does not authorise payment, we will not be responsible for any delay or non-delivery and may not formalise any contract with you.
Can I buy without registering?
This website also allows purchases to be made in guest mode. In this type of purchase, you will be required to fill in only the fields necessary to process your order data.
Once the buying process is complete, you will be offered the opportunity to register as a user or continue as unregistered user.
What is the billing policy?
In accordance with article 68 of Spanish Law 37/1992, of 28 December, on VAT, the delivery of goods will be understood to be located in the territory where Spanish VAT applies if the delivery address is in Spanish territory, except for Canary Islands, Ceuta and Melilla. The legal VAT rate in force will apply depending on the particular item in question.
For orders with a delivery address in the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT by application of the provisions of Spanish Law 37/1992, without prejudice to the application of taxes and duties corresponding to the current regulations in each of these territories. You expressly authorise us to issue the invoice electronically, indicating at any time if you wish to receive an invoice on paper, in which case we will issue and send you the invoice in that format.
In the event that the authorities of the country of destination of the goods require the payment of additional fees that may arise from the customs duties, tariffs, import taxes and any other expenses and/or excise taxes necessary for the buyer to receive the artwork, these expenses will be borne by the buyer.

For contractual purposes, you agree to use this electronic means of communication and acknowledge that all contracts, notices, information and other communications sent by us electronically comply with the legal requirements to be in writing. This condition will not affect your legally-acknowledged rights.
What is our liability?
Unless otherwise expressly provided in these Conditions, our liability in connection with any artwork purchased on our website will be strictly limited to the purchase price of the product.
We will not be liable for any failure or delay in fulfilling any of the obligations assumed, when this is due to events outside our reasonable control (Force Majeure events).
Force Majeure Events will include any act, event, lack of performance, omission or accident that is beyond our reasonable control.
The obligations will be suspended during the period in which the Force Majeure Event continues, and we will extend the performance deadline to comply with these obligations for a period equal to the duration of the Force Majeure Event. We will use all reasonable means to end the Force Majeure Event or to find a solution that allows us to fulfil our obligations despite the Force Majeure Event.
Can I use content that is on the website?
The content that we make available on our Website is our exclusive property and we share it with you so you can read it and analyse for personal use. We remind you that the contents of our website are protected and any reproduction, distribution, public communication, disclosure and transformation of the content and/or any of its components is prohibited, including by way of non-limiting example, text, images, marks, graphics, logos, buttons, software files, colour combinations, as well as the structure, selection, arrangement and presentation of its contents, without damaging the rights that third parties may have over any of the elements of the content.
